Regulatory references
Public procurement contracts code (CMP)
Codified set of measures of a legislative or regulatory origin, relating to contracts issued to meet the needs of municipal authorities and other public bodies.
The code is published by the Direction des Journaux Officiels, 26, rue Desaix, 75727 Paris Cedex 15.
General administrative clauses (CCAG)
Document of a regulatory origin, containing contractual provisions of a legal and financial nature, applicable to all contracts covering services of a similar nature or in the same business sector.
There are four types of CCAG document:
Works CCAG,
Industrial contracts CCAG (CCAG/MI),
Intellectual service contracts CCAG (CCAG/PI),
Routine supplies and services CCAG (CCAG/FCS).
General contract data requirements (Cahier des Clauses techniques générales - “CCTG")
CCTGs contain the technical provisions that apply to the provision of all goods and services of a similar nature. They concern primarily building and construction work, and the supply of consumables.
List of Common Administrative Clauses (Cahier des Clauses Administratives Communes -“CAC”) and the List of Standard Contractual Clauses (Cahier des Clauses Contractuelles Types -“CCT”)
The CAC is a document prepared at DGA level that supplements the CCAGs by bringing together a certain number of specific DGA clauses that apply to all contracts and enable the contract to be abbreviated. As this document has in fact already been published in the Official Bulletin (“BO”), it is only necessary to refer to it in the list of contractual documents.
The List of Standard Contractual Clauses (CCT), also called the summary of standard clauses, is a document that contains sample clauses. These sample clauses are accompanied by commentary pages that correspond to the various situations within which the buyer may find himself. The latter, when he is drafting his contract, must select the clause that corresponds to his particular circumstances.
