Definition contracts

These contracts are governed by Article 73 of the Public Procurement Contracts Code (PPCC).

This article can only be applied if the public entity is not in a position to stipulate the terms of the contract, due to uncertainties concerning :
  the objectives and performances to achieve,
  the basic techniques to use
  the human and material means to implement.

The study of the contract conditions can lead to the realization of a scale model or a demonstrator.

Those contracts shall allow to estimate the price level, the determination clauses and to provide the different stages of the future realization contract.

The definition contract is different from the competitive dialog because it does not include any realization stage.

In the scope of a single procedure, the provisions of performance following up several definition contracts, having the same purpose and performed simultaneously, are awarded after competitive submission between the suppliers of the definition contracts.

The number of definition contracts has not to be inferior to three, subject to an insufficient number.

The "Defence" decree mentions in Article 2 - II d) the possibility to award the realization contract to the author of the solution selected without call for competition nor publicity.
