Contractual obligations
Within the framework of a classified contract or a contract with security clauses, the contractor’s main contractual obligations include the following points in particular:
1/ Application of security measures:
laid down by the regulations relative to protection of defence secrets,
defined in the security annex.
2/ Subcontracting protected work:
security clearance checks and, where necessary, request for the legal entity security clearance of its future subcontractors,
drawing up security annexes for its subcontractor contracts,
(in conjunction with the contracting authority for approval)
verification of the physical suitability of the subcontractor’s premises and computer systems, in the case of classified contracts.
3/ Controls on compliance with security measures on the part of the holders of classified contracts:
Security visits and inspections are carried out, either by the contracting authority or by the Directorate for Defence Protection and Security (DPSD), to check compliance and effective application by the contractor of the regulatory and contractual security specifications.
Such visits and inspections may reveal a need for corrective action to be undertaken by the contract holder.
