Adapted procedure contracts

Contracts following an adapted procedure (Article 28 of the Public Procurement Contract Code, “PPCC”)

They correspond to the former Invoiced Purchases (ASF) of the Public Procurement Contracts code before 2001 and to former Contracts without prior formalities of Public Procurement Contracts code of 2001. They concern contracts for amounts less than €135.000 exc. tax. (for supplies and services contracts) and €210.000 exc. tax. (for infrastructure contracts). Payment for the corresponding services can be made on submission of the invoice. These contracts are subject to a call for competition, but it is the contracting authority’s responsibility to undertake a rather extensive procedure, depending on the type of service and the financial amount involved.

These thresholds are calculated in accordance with the provisions of Article 27 of the PPCC by the contracting authority (PA):
-  by operation or by construction unit, for this kind of work,
-  by reference to homogeneous nature, for supplies and services,
-  regardless of the number of suppliers.

These contracts have to be awarded after call for competition and advertising, except :
-  if the circumstances justify it,
-  if the amount is less than €4.000 exc. tax.
-  or if they concern the article 35-II.

Contracts concerned by Article 30 of the PPCC

They are contracts, regardless of their amount, covering:
-  legal services,
-  social welfare and cleaning services,
-  recreational, cultural and sports services,
-  educational services, as well as professional qualification and assimilation services.

Article 30 indicates that the contracts concerning services that are not mentionned in the the list of Article 29, can be awarded,whatever their amount, according to an adapted procedure. These contracts have to be subject to competition in the same condditions as the adapted procedures (cf. above). When the amount of the contract is above €210.000 exc. tax., it has to follow the dispositions of Article 6 (technical specifications) and has an award announcement.
