These essentially comprise purchase orders and service orders for the confirmation of tranches.
Purchase orders
As its name implies, a purchase order is the instrument used to confirm successive orders forming part of a purchase order contract.
The purchase order issuance conditions must be defined in the initial contract, which sets the conditions under which purchase orders are issued.
The conditions appearing in the purchase order may not run counter to or modify the conditions of the initial contract.
A purchase order is issued by the PRM or his delegate, and the contractor has a certain time in which to notify any observations or disagreement.
Tranche confirmation service order
A service order (“ordre de service” - OS) is a unilateral governmental instrument, and the contractor does not indicate his approval for its issue. However, he has 15 days in which to make comments.
All characteristics of any conditional tranche that has to be confirmed by service order must be included and defined in the contract (purpose, price, completion dates, funding conditions, etc.). The instrument issued must strictly comply with the conditions set out in the contract. Some contracts may stipulate that the contract has some time to make his comments.
If it becomes necessary to change any elements defined in the contract, an additional clause should be included.
